How do I sell Dubai off-plan property before handover?

Off-plan property in Dubai can be resold before the project is handed over, a structure called assignment or off-plan resale. This is one of the most distinctive features of the Dubai market: most major developers (Emaar, Sobha, DAMAC, Aldar, Nakheel) permit assignment once a defined portion of the purchase price has been paid. The mechanism is the Sales Progression Form (SPF), filed at the developer's sales office and validated by the Dubai Land Department.

The standard process

  1. Verify with the developer that your unit qualifies for assignment (most require 30% paid).
  2. Identify a buyer, through agent network, secondary market platforms (Property Finder, Bayut), or direct.
  3. Both parties sign a Memorandum of Understanding (MOU) and put a 10% deposit in escrow.
  4. Visit the developer's office to file the Sales Progression Form, admin fee 1–5% typically.
  5. Apply for the DLD No-Objection Certificate (NOC), AED 525–5,250 depending on developer.
  6. DLD updates the title-deed registry to the new buyer's name; new buyer assumes remaining payment plan.
  7. Process timeline: 2–4 weeks from MOU to NOC issuance.

Cost breakdown for the seller

  • Developer admin/transfer fee: 1–5% of original purchase price (Emaar 2%, Sobha 4%, DAMAC 1%)
  • DLD NOC fee: AED 525–5,250 (paid by buyer in most transactions, but negotiable)
  • Agency commission: 2% of resale price (standard)
  • No capital gains tax in the UAE
  • Net proceeds: resale price minus original cost minus fees + any unpaid future installments
